Introduction to the Legal System

Law made from three sources in australia.
1.  Parliament
2.  The Courts
3.  Ministers and public servants
Most of the law is made by parliaments, law start at parliaments by a (bill) and if it is passed by both houses  it'll becomes law, The Governor can then "consent" of the new law. The bill will become law on the date of the Governor’s assent.
Courts resolve disputes about the law. Judges look at decisions which are made in prior judgments and follow the same approach. The courts’ judgments, collectively, are known as the common law.
Some of the rules governing the law and the Court:
  • The judge's decision is binding on the parties participants in the case.
  • If a party wishes to appeal the judgment, they must do this within a specified period of time.
  • Upon appeal, the verdict may either be changed, or stay the same.
  • A party may be able to continue to appeal a decision until the matter is decided in the High Court. The High Court’s decision is final
